APPLICANT REQUESTS THAT:

The Fitness Assessments (FAs), dated 23 Jun 10 and 28 Aug 13, be declared void and removed from the Air Force Fitness Management System (AFFMS).

APPLICANT CONTENDS THAT:

He had an undiagnosed pre-existing medical condition that precluded him from successfully passing the contested FA.  

During the FA he began experiencing chest pains, which was diagnosed in September 2011 as Angina.  He believes that his chest pains and the fact that it was not being treated at the time of the FA directly resulted in his failure.  

In support of his appeal the applicant submits; a personal letter to the board, medical records dated back to 2009 indicating he had a long history of chest pains; and a letter from his medical provider validating his medical condition.

STATEMENT OF FACTS:

On the date the application was submitted the applicant was serving as a Master Sergeant (E-7) in the Regular Air Force.

On 23 Jun 10, the applicant participated in a FA, attaining an overall composite score of 73.75, which constituted a “Poor” assessment.  The applicant was credited with the following component scores:  Cardio – 14:03/34.00 points, Abdominal Circumference – 35.00”/22.50 points, Push-ups – 46/9.00 points, Sit-ups – 42/8.25 points.

A letter provided by the applicant and signed by his medical provider on 21 Sep 13 requests “removal of PT failure from his military record system as his PT failure occurred while he was undergoing cardiac work-up for chest pain.  His full work-up occurred in 2008, as well as 2011.”

On 14 Feb 14, a similar request was considered by the Fitness Assessment Appeals Board (FAAB) and denied based on “no letter from the commander supporting removal of the Fitness Assessment.  Also, the medical condition was present on the two Fitness Assessments prior and did not impact those tests.”

AIR FORCE EVALUATION:

AFPC/DPSIM recommends denial of the applicant’s request to remove FA dated 23 Jun 10, due to the lack of supporting evidence.  Specifically, the applicant did not provide an invalidation letter from his Unit Commander.  

In regards to the 28 Aug 13 FA, DPSIM states that no action is needed, as the FA in question has already been corrected to reflect exempt in the correct component in AFFMS.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation, with attachment, was forwarded to the applicant on 28 Feb 14 for review and comment within 30 days (Exhibit C).  

In response to the Air Force evaluation the applicant submits a personal letter to the Board and a signed letter from his commander, dated 17 Mar 14.  The letter supports his request to remove “his 23 Jun 10 FA from his record due to a pre-existing medical condition that was not diagnosed until September 2011.”

THE BOARD CONCLUDES THAT:

1.	The applicant has exhausted all remedies provided by existing law or regulations.

2.	The application was timely filed.

3.	Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. The FA, dated 28 Aug 13, has been corrected in the AFFMS to reflect “Exempt” for the cardio component and giving him an overall “Excellent” score of 91.75.  As such, the only remaining issue before us is the contested FA, dated 23 Jun 10.  After thoroughly reviewing the evidence of record and noting the applicant’s contentions in this regard, we believe he has met his burden of establishing the contested FA should be declared void. Although the FAAB disapproved this portion of the application, as the applicant failed to provided documentation from his unit commander, in response to the Air Force evaluation, the applicant provided a letter from his commander requesting the contested FA be removed due to his chest pains.  In view of this evidence and given that his medical provider and medical records, validate his medical condition did in fact preclude him from passing the FA, we find a totality of the evidence supports favorable consideration of this request. Therefore, we recommend the applicant’s records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that the Fitness Assessment, dated 23 Jun 10, be declared void and removed from the Air Force Fitness Management System.
